Malaysia’s Health Ministry Aims to Reintroduce Tobacco Control Bill in Parliament

The Malaysian Ministry of Health aims to reintroduce the Tobacco and Smoking Control Act to Parliament in the near future, in order to implement it by 2014. The Minister of Health, Dr. Adham Baba, has stated that the ministry has reviewed and will continue to submit this revised bill to the Parliament’s special selection committee, which had agreed to it last year. However, the process of resubmitting the bill has been delayed due to the Parliament’s dissolution on October 10, 2022.

Aims to Reintroduce Tobacco

The Tobacco and Smoking Control Act of 2022, introduced by the Ministry of Health on July 26, 2021, prohibits citizens born in 2007 or later from smoking, buying or possessing tobacco products, or e-cigarettes. According to Article 17 of the bill, citizens born on or after January 1, 2007 are prohibited from smoking any tobacco or substitute tobacco products, using any smoking device, or possessing any tobacco or smoking substance, substitute tobacco products, or smoking device.

Citizens born on or after January 1, 2007, who purchase tobacco products, smoking substances, substitute tobacco products, or smoking devices, may face fines of up to RM5,000 if convicted. However, due to controversies surrounding provisions, particularly those involving the “smoke-free generation” (GEG), the bill was brought to the parliamentary special committee for further discussion and revision.

Former Minister of Health Dr. Adham Baba believes that the act is already quite comprehensive, and the parliamentary special selection committee, which he led, had made revisions based on suggestions. Dr. Adham Baba had intended to introduce the Tobacco and Smoking Control Act for its third reading in the Parliament’s Lower House in October 2022, but the Parliament was dissolved. According to former Lower House Speaker Azhar, bills that have been passed in the Lower House but not yet in the Upper House will need to be resubmitted in the new Parliament.

The aim of the Tobacco and Smoking Control Act is to reduce the number of smokers and the negative health consequences of smoking, especially among young people. The act includes provisions on smoking bans in public places, packaging and labeling regulations, and smoking cessation programs. It is hoped that the implementation of the act will contribute to a healthier society in Malaysia.
